RE: MEMBERS MEETING AT KBC PREMISES

Further to our letter dated 17th September 2011 we wish to confirm that the workers meeting will be held at the KBC premises on Friday, 14th October 2011. The Venue will be confirmed later from Head of H/R Mr. Siwatom.

This follows a successful meeting between the CEO of KBC and the Union on the 12th October, 2011. The meeting will be held at 5pm.

The agenda remain the same as communicated vide our letter of 17th September, 2011.

Please attend in large numbers.

Dear Brothers / Sisters,

RE: SALARY REVIEW PERIOD 1ST JANUARY 2010 TO 31ST  DECEMBER 2011

This is in response to several complaints and enquiries I have continued to receive on the above matter. Following is the correct position on what we have done and continue to do as to achieve the best we can for you.

  1. After we entered disagreement with PCK, we moved to Industrial Court so as to get an award as provided for under the laws of the land.
  2. Unfortunately the employer has made effort to block our progress by bringing legal interpretations to deliberately delay the court progress.
  3. The two cases are done for hearing on the 18th and 24th October 2011 and we are hopeful the results will soon be known. We are however exploiting alternative action we may take to get you your rights.

We will come back to you as soon as we are ready for the action. Kindly watch this space in the meantime we thank all of you for your patience and the efforts you have continued to make to sustain the corporations business.

Dear Brothers / Sisters,

RE: ON GOING C.B.A. NEGOTIATIONS

We are aware that you have been following the progress being made on the above matter. This is therefore to update you on the current position and progress so far made on the same. Several meetings have been done and progress made. We have agreed on all items except two namely:

1. Redundancy and severance payment.
2. Salary.

The following is the position of each party.

1. REDUNDANCY
Union demands that a severance pay of 2 months (60 days) salary for each completed years of service be paid on Redundancy or retrenchment. The Management insists on payment of 16 days for each year of completed service.

2. SALARIES
The issue on salaries is ongoing and the Management have made some proposals which we are considering and we are soon meeting you for discussion so that we get your consideration before appending our signatures. Our next meeting is on 12th October 2011.

The General Secreatary of COWU (K) - Mr. Benson Okwaro has written a press statement commenting on a circular issued by the Permanent Secretary and Head of the Public Service Ambassador Francis Muthaura:

 

PRESS RELEASE 

RE: THE SALARIES AND REMUNERATION  COMMISSION 

The Communication Workers Union of Kenya is appalled with a circular issued by the Permanent Secretary and Head of the Public Service Ambassador Francis Muthaura dated 25th May, 2011 purporting to curtail setting or review of salaries and allowances of state and public officers. 

We wonder what prompted the permanent secretary to issue such a circular without first consulting experts and other stake holders. The new constitution differentiates between a state officer and a public officer as it pertains to the functions of the commission. It clearly states that the commission will advise on remuneration and benefits of public officers and not to determine them.  

Whereas the new constitution gives a right to a worker to form, join or participate in the activities and programs of a Trade Union, this circular is both retrospective and untenable. As a workers’ Union, representing employees of PCK, Telkom (K) Ltd and KBC, we shall continue to champion the interests of our members including better salaries and benefits for them. Rights of Collective Bargaining are enshrined in the constitution and no employer or Government can deny the workers’ their rights. 

This circular has been issued in bad faith and hence we are appealing to the PS to reconsider its impact and revoke it immediately. Meanwhile we are in total agreement with the stand taken by COTU (K) to ignore the circular as we wait for further action to be taken by them (COTU) which we will support.
